Oceania 2024 Awatere Village Cashback Promotion

1. Subject to the terms and conditions set out below, Eligible Claimants are entitled to claim from Oceania Village Company Limited (“Oceania”) an amount of $5,000.00 (“Cashback Amount”) when purchasing a licence to occupy for a new apartment at Awatere Village (“Awatere”) pursuant to an Occupation Right Agreement (“ORA”).
2. To be eligible for the Cashback Amount, the following criteria must be met:
   1. The claimant must submit an application to Oceania for the occupation of a new (previously unoccupied) independent living apartment (“Apartment”) at Awatere (“Application”);
   2. The Application must be submitted on or before 29 February 2024;
   3. The Application must be accepted by Oceania; and
   4. The claimant must pay to Oceania the Occupation Licence Payment, as set out in the Application, within 90 days of the date of the Application.

      Claimants who meet this criteria will be “Eligible Claimants”.

3. For the avoidance of doubt, the Cashback Amount is not available for claimants who submit an application for an apartment that has been previously occupied.
4. Only one Cashback Amount per Apartment is available.
5. The Cashback Amount does not reduce the Occupation Licence Payment (as that term is defined in the ORA) for the Apartment.
6. The Cashback Amount does not affect the Deferred Management Fee (as that term is defined in the ORA) payable for the Apartment.
7. The Cashback Amount will be paid to the Eligible Claimant by bank transfer within 10 business days of the date on which they settle their Occupation Licence Payment for the Apartment.  The Eligible Claimant will need to provide all relevant information as required by Oceania in order for this payment to be made, including any requirements to comply with any statutory requirements.
8. An Eligible Claimant must pay back the Cashback Amount to Oceania if they terminate their ORA in accordance with the 90 Day Right Place Guarantee (as defined in the ORA).  The payment of the Cashback Amount to Oceania must be made within 10 working days of the 90 Day Right Place Guarantee being exercised by the Eligible Claimant.
9. This offer is not transferable, assignable or exchangeable.
10. Oceania is not liable for any damages or claims whatsoever arising from an Eligible Claimant’s participation in this promotion.
11. Oceania’s collection, use and disclosure of personal information for this promotion is subject to the Oceania’s Privacy Policy (available at https://oceaniahealthcare.co.nz/privacy-policy) and is incorporated into these terms and conditions.
12. Participation in this promotion is deemed acceptance of these terms and conditions.
